Methodology

Mr. Guerra applies a structured, standards-based methodology in the evaluation of crane operations and crane-related incidents. His analyses are grounded in documented evidence, applicable regulatory and consensus standards, and current field practice. Each engagement is evaluated independently based on the specific facts and circumstances presented.

Analytical Process

 Mr. Guerra’s analytical process may include, as appropriate:


  • Identification of relevant technical and operational issues
  • Evaluation of crane setup, configuration, and lift execution
  • Review of lift planning, communication, and supervision practices
  • Assessment of consistency with applicable standards of care
  • Consideration of alternative explanations and contributing factors


The scope, depth, and focus of analysis are determined by the questions presented and the information available.

Evidence Review

 Methodological evaluation may include review of available project documentation such as lift plans, drawings, load charts, inspection records, operating procedures, incident reports, photographs, videos, and applicable policies. The scope of review is informed by the materials available and the nature of the issues under consideration.

Standards and Regulatory Framework

 Analyses are conducted with reference to applicable OSHA crane and derrick regulations, ANSI standards, ASME standards, and recognized industry practices, as appropriate to the equipment involved, the time frame of the events, and the jurisdiction at issue.

Integration of Current Field Practice

 Ongoing involvement in crane operations and lift execution informs the practical application of standards and industry practices. This current field experience provides direct familiarity with contemporary equipment, procedures, and operational constraints relevant to the evaluation of crane operations and incidents.

Assumptions and Limitations

 Mr. Guerra’s opinions are based on the information made available at the time of analysis. Where complete information is not available, reasonable assumptions may be required. Additional materials, testimony, or information received after the initial review may require further evaluation and could affect opinions.


No methodology can eliminate all uncertainty, and opinions are offered within the limits of the information reviewed.

Opinion Formation

Expert opinions are formed through analysis of the available evidence, application of relevant standards, and consideration of operational context. Opinions are expressed independently and are subject to refinement should additional information become available.

 All opinions are developed independently and without advocacy. Mr. Guerra does not assume responsibility for the actions of any party and does not offer legal conclusions. His role is limited to providing objective technical analysis to assist counsel and other stakeholders in understanding technical and operational issues.
